In full respect of Customer rights and to guarantee complete satisfaction, Rada.it undertakes to recognize the Customer’s right of withdrawal, as provided for by Italian Legislative Decree no. 185 of 22 May 1999 implementing Directive 97/7/EC on consumer protection in distance contracts, specifically Article 5 regarding the exercise of the right of withdrawal.
The consumer has the right to withdraw from any distance contract, without penalty and without specifying any reason, within fourteen working days starting from:
a) for goods, from the day of receipt by the consumer, provided the obligations referred to in Article 4 have been fulfilled, or from the day such obligations are fulfilled if later, provided this occurs no later than three months from the conclusion of the contract;
b) for services, from the day of conclusion of the contract or from the day the obligations referred to in Article 4 are fulfilled, if later, provided this occurs no later than three months from the conclusion of the contract.
If the supplier has not fulfilled the obligations referred to in Article 4, the withdrawal period shall be three months starting from:
a) for goods, the day of receipt by the consumer;
b) for services, the day of conclusion of the contract.
Unless otherwise agreed between the parties, the consumer may not exercise the right of withdrawal for contracts involving:
a) services whose execution has begun, with the consumer’s consent, before the expiration of the fourteen-day period;
b) goods or services whose price depends on fluctuations in financial market rates beyond the supplier’s control;
c) custom-made or clearly personalized goods or goods that cannot be returned by nature or are liable to deteriorate or expire rapidly;
d) sealed audiovisual products or computer software opened by the consumer;
e) newspapers, periodicals, and magazines;
f) betting and lottery services.
The right of withdrawal is exercised by sending written notice within the prescribed period to the supplier’s registered address by registered letter with acknowledgment of receipt.
The communication may also be sent within the same period by telegram, telex, or fax, provided it is confirmed by registered letter with acknowledgment of receipt within the following 48 hours.
If the goods have already been delivered, the consumer must return them or make them available to the supplier or a person designated by the supplier, according to the methods and timeframes provided in the contract.
The deadline for returning the goods may not be less than fourteen working days from the date of receipt.
The only costs payable by the consumer for exercising the right of withdrawal are the direct costs of returning the goods to the sender, where expressly provided for in the distance contract.
